Federal Judge Rules Against ED in Latest Legal Challenge to Implementation of CARES Act

A federal judge in Massachusetts has ruled against the Department of Education’s (ED) implementation of the Coronavirus Aid, Relief, and Economic Security (CARES) Act, blocking the department’s guidance on allocating aid for colleges and students within the state, which the state argued has led to the exclusion of tens of thousands of vulnerable students.

“The Court ALLOWS the Commonwealth’s Motion for a Preliminary Injunction, Doc. No. 3, enjoining the Defendants and their agents from enforcing the IFR as to any institution of higher education in the Commonwealth of Massachusetts and as to any student attending a school that is located within the Commonwealth of Massachusetts,” the legal order read.

The legal challenge joins separate lawsuits from California and Washington state, which levied similar arguments and have racked up a number of rulings that have blocked the department’s guidance and interim final rule in relation to funds provided by the CARES Act.
