2002 Negotiated Rulemaking

Non-Quick Fix Documents Available for Team I (Student Loan Issues) Upcoming NegReg Session

[The Department of Education released the four documents appearing below in advance of the Team I (Student Loan Issues) Negotiated Rulemaking sessions to take place the week of March 4. The following message about the files is from Dan Madzelan of the Department of Education. A draft agenda for next week's sessions is expected later this week.]

"Attached (in our customary dual formats--MS Word and Adobe Acrobat) are three packages of proposed regulatory language plus a separate guide to the contents of the three packages. This "road map" lists our remaining 17 non-quick fix items. However, your careful review of the document will reveal that we've in fact listed 24 items. Four of these are conforming changes to one or both of the other loan programs. For example, rehabilitation of judgments was identified as a Perkins program issue but we're providing corresponding changes to both FFEL and Direct Loans. Also, three issues were previously identified as pertaining to both FFEL and Direct Loans. We've separated those here and have noted them on the road map as 'Separated from FFEL change' in the 'ED Notes' column.

"We have grouped the issues by program--Perkins, FFEL, and Direct Loans--inasmuch as we customarily group NPRMs by program. I have included in the FFEL package Team Two's language for 'no fault' late disbursements. As you may be aware, Team Two had a thorough discussion of this issue in the context of Fed Up item #35, and even added an item relating to PLUS."
