With the 2016 borrower defense to repayment regulations currently in effect, the Department of Education (ED) in March issued guidance reminding institutions of financial responsibility reporting requirements. Because the regulations became effective at an unusual time of year, ED's guidance stipulated that any required notifications must be made by May 14, 2019. However, ED has received a number of questions about the reporting requirements, and said in an Electronic Announcement published Monday that once it provides answers, schools will have the opportunity to amend or supplement their reports.

U.S. DEPARTMENT OF EDUCATION

On March 15, 2019, the Department of Education issued an Electronic Announcement, with the subject "Guidance Concerning Some Provisions of the 2016 Borrower Defense to Repayment Regulations." Recently the Department has received a number of inquiries as to the implementation of the guidance in the Electronic Announcement relating to the reporting requirements in the financial responsibility regulations.

As described in the March 2019 Executive Order on Improving Free Inquiry, Transparency, and Accountability at Colleges and Universities, the U.S. Department of Education will calculate and disseminate data metrics by field of study through the College Scorecard. In order to accurately calculate the data metrics referenced in the Executive Order, ED has enabled functionality for institutions to update their historical program-level enrollment data reported to the National Student Loan Data System, from which College Scorecard data metrics will be derived.

The Secretary announces the annual updates to the ICR plan formula for 2019 to give notice to borrowers and the public regarding how monthly ICR payment amounts will be calculated for the 2019-2020 year under the William D.
