NEWS FROM NASFAA

As institutions across the country grapple with new online education options for students seeking to continue classes remotely, the Department of Education (ED) today published a Notice of Proposed Rulemaking (NPRM) to restructure regulations related to distance education. A negotiated rulemaking committee met last year to discuss the regulations and reached consensus, which is reflected in ED’s proposed rule. 

The Federal Emergency Management Agency (FEMA) has declared multiple states and U.S. territories affected by COVID-19 as major disaster areas — and it is expected that more states may be added to the disaster area list in the future. These declarations free up emergency funds that can be sent to "state, tribal, and eligible local governments and certain private nonprofit organizations for emergency protective measures," and in some cases, trigger the Department of Education’s (ED) general disaster guidance.

NASFAA has responded to the Department of Education's request for public comment on a new, single form combining the applications for the Public Service Loan Forgiveness (PSLF) program and the temporary program designed by Congress in 2018 to assist borrowers whose requests for debt relief under the PSLF program were rejected. NASFAA applauded ED's efforts to simplify the form for borrowers while offering suggestions for further improvement. Read NASFAA's full comments.

Hugh comes to NASFAA from POLITICO, where he worked for the last three years as a legislative reporter covering parliamentary procedures in both the House and Senate with a particular focus on legislation related to the appropriations process, health care, education, and technology. Hugh graduated from Syracuse University in 2015 with an undergraduate degree in political science and economics and a master's degree in journalism. Fun fact: Hugh enjoys all things tennis. The form makes it easier for borrowers to complete through simplified language, and easier for loan holders through a uniform, common format.

The Secretary proposes to amend the general, establishing eligibility, maintaining eligibility, and losing eligibility sections of the Institutional Eligibility regulations issued under the Higher Education Act related to distance education.

The revisions to this collection is a result of enhancements made to the current system to collect the compliance audits/financial statements in the appropriate format (e.g. revised question text and required uploads) from the foreign institutions that are required to submit audits in accordance to the Department's regulations.
