A personal financing company that oversees student loan refinancing products is suing the Department of Education (ED) to immediately end the ongoing freeze on federal student loan repayments and interest accrual — only for borrowers who are not eligible for loan cancellation — arguing that the latest extensions offered by the administration were unlawful.

NASFAA signed on to a letter sent by the American Council on Education urging the Department of Education (ED) to carry out a formal negotiated rulemaking process for its ongoing foreign gifts and contracts disclosure regulations, which the department recently requested comments on. The signatories of the letter argue that ED’s information collected request concerning foreign gift reporting does not increase clarity or reduce the administrative burden for institutions and cite concerns related to the department’s reporting portal, confusion over guidance for reporting tuition paid by foreign sources, as well as a gross underestimation of the administrative and cost burden associated with the newly proposed guidance. “Much of this burden could be addressed through a negotiated rulemaking process to provide clarity around definitions, and updates to the reporting portal through engagement with the stakeholder community” the letter reads.
