In a letter to the Department of Education (ED) on Thursday, NASFAA joined dozens of associations representing four- and two-year public and private colleges and universities urging the department to allow undocumented students, Deferred Action for Childhood Arrivals (DACA) recipients, and international students to be eligible to receive emergency aid grants from the new round of Higher Education Emergency Relief Fund aid (HEERF II).
The letter points to an FAQ document published when the funds were made available to institutions earlier this month that made clear the Interim Final Rule (IFR) ED issued in June does not apply to the Consolidated Appropriations Act, 2021, and HEERF II.
The IFR limited grants to students who are Title IV-eligible, though neither the FAQ nor any other guidance issued by ED regarding HEERF II clearly indicated whether DACA recipients or undocumented and international students are eligible to receive HEERF II grants. As such, the letter asks ED to issue additional guidance as soon as possible making clear all students at eligible institutions, including undocumented and international students, are eligible for the emergency aid grants.
